The base price for the Standard Services provided by CGWIC is US$
If the Launch occurs after April 30, 1990, such base price shall be escalated by
n where "n" is the number of multiplying it by (1.005) months, or part thereof if such part exceeds 15 days, from April 30, 1990, to the Launch Day, provided that there shall be no escalation of the base price if:
(a) the Launch Day is delayed or postponed on account of
the Launch Vehicle not being ready for the Launch, and such nonreadiness is not due to a postponement requested by, or default on the part of, the Client;
Or
(b) the Launch Day is delayed or postponed as a result
of any commitment or obligation of CGWIC to a CGWIC Client; or
(c) the Launch Day is delayed or postponed as a result of the occurrence of any Event of Force Majeure or as a result of any act or omission by the Government of the People's Republic of China; or
(d) CGWIC requests a postponement of the Launch Day, the
Launch Period or the Launch Slot for any reason other than a default on the part of the Client.
The price for the Reflight option shall be ten percent (10%) of the price for Standard Services as escalated per Paragraph 8.1 above to the Launch Day. The price for the cash refund option shall be sixteen percent (16%) of the price for Standard Services as escalated per Paragraph 8.1 above to the Launch Day minus US$100,000.
The total fixed portion of the price for the Services under this Contract (the "Fixed Launch Service Fee") shall be the base price for the Standard Services.
The Fixed Launch Service Fee for Services under this Contract shall be adjusted to include the price for the Reflight option or cash refund option as appropriate if the Client elects or changes an option in accordance with Sub-paragraph 11.2 (a) below.
