(HMOCS): COMPENSATION
You asked where we stood on the General Compensation Scheme (GCS) for HMOCS members.
2. At one stage we were hoping to announce details of the GCS at the same time as the Nationality Package was announced ie in December 1989. This proved not to be possible and subsequently both Peking and Hong Kong recommended that it would be wise not to rush ahead with consultation with the Chinese. They recommended that we should wait at least until after the negotiations on constitutional development had finished and until after the Basic Law had been promulgated.
3. Current thinking is that we should aim to release details of the GCS at about the same time as the Nationality Bill will be passed into law ie July 1990. Consultation need not, indeed would perhaps better not be, on the formal JLG context. It could be done through the JLG office, giving the Chinese, say, six weeks to consider after which we could impose a deadline.
4. I have prepared a draft submission. This has been cleared by the ODA and Mr Fifoot, Legal Adviser, has commented on it. Hong Kong and we are in broad agreement on the scheme. It should be possible to submit early after Mr Maude's return from Hong Kong.
