Thank you for your memo of 12th inst. in relation

to the above matter.

You have requested advice regarding the procedures amendments required to extend the abovementioned scheme to include officers of the ICAC.

A similar request for advice from the Secretary for the Civil Service was very recently considered by these Chambers and I am therefore enclosing a copy of the advice prepared by my colleague Mr Henry Nauta, Crown Counsel on 31.10.89.

You will then appreciate that the matters you raise are matters for the Home Office to decide with regard to procedure but I would suspect that a further Royal Warrant would be required to extend the scope of the existing scheme, your para. 3(a) refers.

With regard to your para.

to your para. 3(b) the proposals from ICAC are in order save only that with reference to App. I para. 3, I do not see how previous service with Police is relevant to present consideration unless there is a specific term in the new Warrant permitting such service to be taken into account as the present scheme covers only Immigration and Customs & Excise departments.

I would therefore suggest that the matter be raised initially with FCO who would advise what further input was required from the Hong Kong government but this would be essentially a recommendation of a policy nature as procedural aspects would be matters for the Home Office.
