APPEAL BY A MEMBER OF THE HONG KONG GOVERNMENT CIVIL SERVICE

1.

Under Regulation 69 of the Colonial Regulations, "any officer in a territory has the right to address the Secretary of State". It is not clear to me from these papers whether Mr Hong is still a member of the Hong Kong Civil Service but, since his complaint apparently relates to matters relating to his service, I do not think that we should exclude consideration of his "appeal" under Regulation 69 if it turns out that he has ceased to be a Hong Kong civil servant.

The Regulation requires that any letter etc from such an officer which is received by the Secretary of State "otherwise than through the Governor" will be referred back to the Governor for his report or returned to the writer. cannot recall that we have had a practice of returning letters to the writer and it is therefore appropriate to refer the "appeal" to the Governor with a request for his comments on it as required by Rule 69.

When we receive the Governor's report, we can then give consideration to Mr Hong's "appeal" in order to advise the Secretary of State on his reply.
