14. PREMATURE TERMINATION OF APPOINTMENT

The appointment may be terminated at any time prior to its scheduled date of completion by mutual agreement between the Hong Kong Government and the officer's home force. The Hong Kong Government will provide homeward passages to the United Kingdom for the officer and his family (subject to the same limitations as in Clause 10.3 of this memorandum) together with such other benefits as may be applicable under the appropriate regulations. Such passages must be taken up within one month of the date of cessation of the appointment.

If the officer gives notice in writing of his intention to resign from the service (i.e. from his home force and/or from the Hong Kong Government) before completion of the full period of his appointment, he will be required to refund to the Hong Kong Government :-

(a)

the proportion of the cost of initial outward passages to Hong Kong, including associated baggage and travelling expenses, provided at the commencement of the appointment for himself and his family which the uncompleted portion of the full period of appointment bears to the full period;

(b) the cost of any school passages that were provided

in excess of his eligibility in relation to the actual period of resident service;

(c) the outstanding balance of any advance of salary or

other sums which he may have received, and which may be deemed to be outstanding to the Hong Kong Government.

If the officer resigns during the appointment, he fortfeits his casual leave, normally with effect from the date on which notice of resignation is given.

On first appointment the officer is required to sign an agreement with the authority who acts on benalf of the Hong Kong Government to refund any sums that may be due from him under Clause 14.2. in the event of his failure to take up the appointment or on resignation during the period of appointment.

The officer will not be permitted to retire from his home force during the period of his resident service with the Hong Kong Government

For purposes of discipline, an officer is subject to Colonial Regulations, Civil Service (Disciplinary) Regulations, Civil Service Regulations, the Police Force Ordinance and any other Ordinances or Regulations which apply to the Force or office to which he is appointed.
