Sir,

The Superintendents' Association (SPA) of the Royal Hong Kong Police (RHKP) wish to bring to your attention the following matters which are of major concern to us. We trust that these matters may be speedily resolved to the satisfaction of our members despite the fact that most matters, if not all, have already been highlighted previously to both the Hong Kong Government (HKG) and Her Majesty's Government (HMG) :

Membership of Her Majesty's Overseas Civil Service (HMOCS)

1.1 We request that HMG announce without further delay,

details of special arrangements that will be made for officers of HMOCS who are affected by the constitutional change which will occur in Hong Kong in 1997.

1.2

We request that HMG provide a written undertaking confirming that officers will be fully eligible for any possible future special arrangements (including a general compensation scheme and the protection of pensions) made by HMG for those officers who are affected by the constitutional change occurring in 1997, irrespective of whether or not they have. transferred to the New Pension Scheme.

1.3 We request that HMG provide a written undertaking

confirming that officers who transferred from agree- ment to pensionable terms and/or joined HMOCS after the Joint Declaration was initialled on 26th September 1984 will be fully eligible for any possible future special arrangements (including a general compensa- tion scheme and the protection of pensions) made by HMG for those officers who are affected by the constitutional change occurring in Hong Kong in 1997.

1.4 The Executive Committee of this Association has raised the first request at 1.1 above at Police Force Council meetings on several occasions over a number of years and adequate assurances on the latter two, 1.2 and 1.3 above have never been provided by HMG despite requests from police staff associations, made again over a period of several years. Additionally we consider it unjust to expect officers to make the irrevocable decisions of transferring from agreement to pensionable terms and transferring from the Old Pension Scheme to the New Scheme without first being provided with these reasonable safeguards.
