Right of Abode for Dependants

of UK Expatriate Civil Servants

At present a non-UK spouse of a UK expatriate civil servant employed by the Hong Kong Government on overseas terms is understood to have no legal "right of abode" in the UK unless and until he/she has lived there for

3 years in the case of a British Citizen

5 years for others.

Non-UK spouses may be husbands or wives.

The majority of

cases where particular hardship is likely to occur however in the case of non-UK wives and children of UK residents.

Whilst it is appreciated that assurances have been given that applications will be considered sympathetically this is not likely to help a young widow with a couple of young children at the airport Immigration Counter. A system of registration would help to alleviate the problem.
