THE PROBLEM

The Legislative Council (Electoral Provisions) Ordinance (Chapter 381) needs amendment in the light of the constitutional changes to the Legislative Council planned in 1991 and to introduce improvements in the light of experience gained in previous elections.
RECOMMENDATION AND ADVICE SOUGHT

It is recommended that the
Legislative Council (Electoral Provisions) (Amendment) Bill 1990, as annexed, should be introduced into the Legislative Council.

BACKGROUND AND ARGUMENT Background

The 1984 White Paper on political development announced the introduction of indirect elections to the Legislative Council in 1985.
The Legislative Council (Electoral Provisions) Ordinance was enacted in 1985 to provide the legislative framework for those elections. Elected members were returned for the first time in the Council's history from 12 electoral college constituencies comprising the District Boards and the two Municipal Councils and 12 functional constituencies representing the major economic and professional groups. The number of functional constituencies was increased to 14 in the 1988 elections.

The 1988 White Paper, concluding the political review in 1987, decided that in 1991 the electoral college constituencies, with the exception of the two special constituencies of the

Following a review of the decisions of the 1988 White Paper in the earlier part of this year, this Council agreed that the number of functional constituencies should be increased to 21.
