to clarify the list of disqualifying offices for the

purposes of being registered as an elector or voting

at an election or being elected or nominated as a

candidate or holding office as a member in the

Legislative Council, either of the 2 Municipal

Councils or a District Board (clauses 8, 10 and 17

(adding new section 46 and the Schedule)); and

to make minor and consequential revisions (clauses

13, 14, 15 and 16).

The new Part IA (clause 5) is based upon similar provisions in

the Legislative Council (Electoral Provisions) Ordinance which deals

with the indirect election of members to the Legislative Council in

respect of functional constituencies. New Part IA will deal with

the direct election of such members in respect of geographical

constituencies. The new Part will include sections relating to the

holding of ordinary elections, tenure of office of members,

acceptance of such office, resignation, non-attendance and the

declaration and filling of casual vacancies at by-elections.

3. The cost of holding direct elections to the Legislative Council

in 1991 will cost about $4 million. Otherwise this Bill has no

Public Service staffing or public expenditure implications.
