the Letters Patent and Royal Instructions are required in order to give effect to constitutional changes to the Legislative Council in 1991.

RECOMMENDATION AND ADVICE SOUGHT

It is recommended that a recommendation be made to the Secretary of State that the Letters Patent be amended

(a) to remove all Official Members, other than the three ex-officio Members, from the Legislative Council (Letters Patent VI(1) (C)) ;

(b)

to

provide for the number of Appointed Members of the Legislative Council to be reduced from 20 to 18 and for the number of Elected Members to be increased from twenty-six to thirty-nine (Letters Patent VI (1) (d) and (e));

and that the Royal Instructions be amended

delete reference to Official Members of the Legislative Council and to substitute them by reference

ex-officio Members where

appropriate;

provide for a four-year term for the Legislative Council after 1991 (Royal Instruction XIIA (1) (a) and XXVIIIA);

to reduce the provisions for provisional appointment of Official Members and Appointed Members to the latter only (Royal Instructions XIV);

to provide for a Deputy President to preside at Legislative Council meetings in the absence of the Governor from such sittings (Royal Instructions XXI(2)(a) and (b)); and

to of

provide for the appointment by the Governor а Deputy President of the Legislative Council (Royal Instructions XXI (3)).
