CIVIL LIBERTIES IN HONG KONG
Problem
Cc:
Mr McLaren
Mr Burns
Mr Fifoot, Legal
Advisers
A
1.
A letter from Mr Bowen Wells MP to Mr Maude arguing that the laws governing the use of loudspeakers and the unauthorised collection of money in Hong Kong could inhibit
the development of democracy and need to be reviewed.
Recommendation
2.
I submit a draft reply from Lord Caithness.
Background
B 3.
This letter is a follow up to a previous exchange of
correspondence between Mr Bowen Wells and Mr Maude about the decision to prosecute several leading liberals in Hong Kong for offences committed under the Noise Control
Ordinance and the Summary Offences Ordinance during demonstrations which took place between January and March.
Although several of the individuals concerned have now been
tried and found guilty, the cases are still subject to appeal and therefore likely to remain sub-judice for some
time.
