I have had a chance to consider all the evidence in

When I did so, I bore in mind three things. First,

it is always for the Prosecution to prove their case beyond a

reasonable doubt. Second, to consider the case against each

Dofendant on each of the charges separately. Third, to consider

the evidence in the light of Defence Counsel's final submissions.

The Prosecution's case was presented by way of

Admitted Facts under S650 of the Criminal Procedure Ordinance,

Cap. 221. The whole of the Prosecution's case was therefore

contained in the pages of the Admitted Facts, Exh. 21.

It should be noted here that the "authority" and/or

"permits" referred to in pections 4(17) and 4(29) are "negative avermenta". The Defence have adduced no evidence relating to

this aspect of the chargée.
