a good cause would have an "exouse" to collect donations

without a permit from the Social Welfare Department. If that

argument is accepted, there would be people collecting in

the streets for the control of pollution, to promote nuclear

disarmament, to protect endangered wild-life species and for

other "good" or "worthy" causes, and they would all have the

excuse" provided for under Section 4. Surely this is not

what the Legislature intended.

I say that in order to have an excuse under Section 4,

the activity must be both "necessary" and "justified" in the

circumstances.

I must stress here that I am in total agreement with

Mr. FUN when he said that "each case must be considered in

reference to its own circumstancos".

My rulings in this case relate to the circumstances

of this case, It should not be taken to mean that anyone in future using a loudhailer in public without authorisation doss

so without xw!!. Each sane et ha lanked at in relation

to its own frota.

Having considered all the evidence in relation to each

of those remaining summonses separately, I found that the Prosecution had proved their case on each beyond a reasonable

doubt.
