7. The Secretary of State's approval is needed for any disciplinary action under CR56, 57 or 58 in respect of officers holding an office of appointment which subject to the approval of the Secretary of State; officers who were selected for appointment by the Secretary of State; or officers whose pensionable emoluments are on or above point 38 of the master pay scale. This provision is clearly intended primarily as a safeguard for officers. Given the size and maturity of the Hong Kong Government I see little reason for disciplinary cases involving persons who have no relationship to the Secretary of State ie. any officers on or above point 38 of the MPS but not holding an office which is subject to the approval of the Secretary of State or not selected for appointment by the Secretary of State. I would therefore recommend deletion of the former category as requiring the approval of the Secretary of State.
