The Sino-British Joint Liaison Group (JLG), the body which discusses arrangements for Hong Kong's administration after 1997, is currently dealing with the subject of extradition. They are in the process of devising a model agreement which Hong Kong could use in making its own extradition arrangements with other countries. In the course of this process, a copy of the Commonwealth Scheme was handed to the Chinese representatives on the JLG, to illustrate the present situation.
2. I would be grateful for your advice on two points raised in paras 4(i) and (ii) of the attached letter from Mr Salkeld of the Hong Kong Government Secretariat:
(a) Why is the phrase "any other sufficient cause" included
in Clause 10(3)(a) of the amended Commonwealth Scheme?
(b)
Is it in fact the case that a person may be extradited even though the criminal offences are connected with revenue law, so that the country receiving the extradition request is in practice assisting in enforcing the revenue laws of the requesting country? Does this raise any particular difficulty in practice?
