An Ordinance to amend the Companies Ordinance.

Enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof.
Short title
1. This Ordinance may be cited as the Companies (Amendment) Ordinance 1989.
Registration of prospectus

Section 304 of the Companies Ordinance (Cap. 32) is amended-
(a) by repealing subsection (1A); and
(b) by adding after subsection (2)—–
"(3) Where-
(a) a prospectus delivered under section 38D(1) or 342C(1) comes within more than one class or description of prospectus specified in the Eighth Schedule; and
(b) the fees specified in relation to those classes or descriptions of
prospectus are not of the same amount,
the fee payable for the registration of the prospectus shall be whichever is the higher or, as may be appropriate, the highest of the fees so specified.”.
