The BA, the Administration and the Consultants all agree that the bids submitted by Supertech and

Supertech and WTS on 28 February 1989 contain insufficient detail, and as such fail to meet the requirements of the invitation documents issued to all interested parties -

The Supertech proposal provides few details of the corporate structure of the bidder', and its statement of the company's financial strength is inadequate for the purpose of evaluation, as

the evidence of shareholders' financial support. It does not provide any details on programming, or on its proposed fees and charges. The proposal briefly discusses serving the Territory by various means, primarily by microwave. No mention is made of the company being able to the Government's minimum coverage requirements.

In its submission made on 28 February 198ÿ WTS did not provide an adequate amount of material.

The information relating shareholders, management and sources of capital was scanty, and much of the required financial information was inadequate or simply not provided. Details of the proposed programming arrangements were not provided, though the company did propose that a privatised RTHK should be contracted provide some of the programming.

On 13 April 1989, following a presentation to the BA, WTS submitted unsolicited, additional document s in support of their initial proposals. These new documents amounted to what was in effect a completely revised submission including new proposals for the delivery of their CTV

programmes. Since these documents arrived unsolicited some six weeks after the closing date for proposals the Administration and the BA agreed that

it would not be fair on the other bidders to consider them. The Consultant. have looked at the additional material and have advised that, even taking it into account, the proposals of WTS are generally inadequate.
