the Governor in Council.
To enable the selection of suitable proposals for CTV to be undertaken effectively and with full participation of the BA, which will ultimately be charged with the supervision of the successful operator, we propose that Members refer to the BA, in accordance with section 9(1) of the Ordinance, the function of conducting an inquiry into a suitable system of CTV for Hong Kong and
the legislative, technical and regulatory framework for its implementation (including a detailed examination and assessment by the Broadcasting Authority of all proposals submitted with reference to the Cable TV system). Should this referral be made, the BA will be able to decide under s.12 of the Broadcasting Authority Ordinance whether to appoint a committee to render specialist advice on aspects of the proposals.

Following assessment
the proposals, the Broadcasting Authority will report its conclusions back to Members, who will be invited to make a final decision on award of the CTV licences. Any award will, of course, be subject to the enactment of the necessary legislation and the imposition of licence conditions.
