Charity Commissioners to see whether they can agree in the first place that a trust exists for the purposes set out in paragraph 9 above. Secondly, they should be asked to advise as to how these purposes can best be given effect. Third, (if the Commissioners agree with our assessment of the legal position at present) we should discuss with them and with the British Council, and the Imperial Cancer Research Institute, the terms and conditions on which the trusts should be set up. The creation of the fund for the benefit of students from Hong Kong will, I think, require careful handling and careful drafting, especially in the light of the fact that our interest in Hong Kong will change substantially after 1997.

Accordingly, if you and Hong Kong Department agree, I suggest that one of us should write to the Charity Commissioners along the lines of this minute and seek their views. A meeting might be useful. I will be happy to take this forward if you wish.
