THIS DEED OF APPROPRIATION made the 29

day of

One thousand nine hundred and fifty seven between THE GOVERNMENT

OF HONG KONG by His Excellency Sir Alexander William George

Herder Grantham Knight Grand Cross of the Most Distinguished

Order of Saint Michael and Saint George Governor and Commander-

in-Chief of the Colony of Hong Kong and its dependencies

(hereinafter referred to as "the Government") of the one mart

and the IMPERIAL WAR GRAVES COMMISSION of 32 Grosvenor Gardens

in the County of London a body constituted by Royal Charter

(hereinafter referred to as "the Commission") of the other part

WHEREAS the Government has agreed to set aside in the name of

the Commission the piece or parcel of ground hereinafter more

particularly described at Stanley in the said Colony for the

purposes of a Military Cemetery for the burial of Members of

the Forces of the British Commonwealth fallen in the war of

1939/45 (and Members of the Forces of Her Majesty's Allies

including civilians whose remains also lie therein) AND WHEREAS

it has been agreed that the same shall remain vested in the

Crown but together with the usual appurtenances thereto shall

be exclusively and in perpetuity appropriated as such Cemetery

as aforesaid but upon the terms and subject to the conditions

hereinafter expressed.

NOW IT IS HEREBY AGREED AND DECLARED as follows:-

1. For so long as the Commission shall conform to all statutes

prevailing in the said Colony and Ordinances and Regulations

of the said Colony in force now or hereafter and to the

Conditions and obligations hereinafter contained the piece of

land containing 108,100 square feet or thereabouts as more

particularly described in the plan annexed hereto and thereon

shown edged pink and intended to be recorded in the Land Office

as STANLEY INLAND LOT NO.22 is hereby appropriated exclusively

and in perpetuity for the purposes of a Military Cemetery in

the name and under the control of the Commission TCGETHER with

a right for the Commission with or without workmen or others
