ROADS (WORKS, USE AND COMPENSATION) (AMENDMENT) ORDINANCE 1988
(No. 81 of 1988)
This Ordinance amends the Roads (Works, Use and Compensation) Ordinance so as to simplify the procedure for giving notice of resumption of land where the land in question is already a road. This is done by removing the requirement for notice to be served on every person known to the Secretary for Transport to have any estate, right, share or interest in the land.
2. Other requirements relating to resumption orders remain (e.g. the requirement for notice in the Gazette) and the Secretary for Transport is empowered to accept service of late claims for compensation if satisfied that a claimant has not had actual notice of the order.
Before the Governor assented to the Bill in the name and on behalf of Her Majesty, the Attorney General advised that he could properly do so.
