AFRICAN ELEPHANT: EC REGULATION BANNING THE IMPORT OF IVORY INTO THE EC
Following Mr Muchmore's minute of 20 June, the Minister gave his approval, subject to minor drafting changes, to the draft EC Regulation banning the import of ivory into the European Community. We informed the European Commission of this view. The Commission have notified us that it was not possible to reach the necessary majority on the Regulation through the written procedures, and the matter will be put to the vote at the next EC CITES meeting on 27/28 July.
With the draft Regulation, the Commission also circulated a note recording discussion at the EC CITES Committee meeting on 22 June relating to the "exceptional circumstances", referred to in the Regulation, in which Member States may allow the import of elephant goods. Further discussion of this issue will take place at the next EC meeting on 27/28 July. The purpose of this minute is to inform the Minister of the extent of agreement at present and seek his views on two particular issues; the import of goods for which contractual arrangements have already been made and the re- import of ivory originally imported legally into the EC.
At the meeting on 22 June, there was general agreement that imports could be allowed in the following cases: -
(a)
live baby elephants exported from the country of origin to zoos elsewhere under a scientifically sound management programme for non-commercial purposes;
