each case substitute
"enabling the
Commission"; and
(ii) repeal subsection (2) and
substitute

Where rules are
made by the Commission under
subsection (1), the Governor
in Council may make
regulations providing that a
contravention of specified
provisions of the rules shall
be an offence and may provide
penalties therefor not
exceeding a fine of $2,000
and imprisonment for 3
months.".

In section 2(1) in the definition of
"Commission", repeal "Commission
established under the Securities
Ordinance" and substitute "and Futures
Commission established under the
Securities and Futures Commission
Ordinance 1989 (
of 1989)".
