substitution or variation under section 40 of such a prohibition or
requirement; and where the contents of any notice containing any such
prohibition or requirement are so published, the Commission shall
publish in the Gazette the contents of any subsequent notice relating
to the withdrawal, substitution or variation of such prohibition or
requirement.
(6) Any notice published under subsection (5) may, if the
Commission thinks fit, include a statement of the reasons for which
the relevant prohibition or requirement was imposed, withdrawn,
substituted or varied.
Withdrawal, substitution or variation of notices under section 36, 37 or 38
40. (1) Where a notice under section 36, 37 or 38 is in force,
the Commission may of its own volition, or on the application of the
person on whom the notice was served or any other person affected by
the notice, by notice in writing
(a)
withdraw the notice; or
(b)
substitute another prohibition or requirement for, or vary,
any prohibition or requirement contained in the notice.
(2) If, on an application made by a person under subsection
(1), the Commission refuses to withdraw, substitute or vary a
prohibition or requirement imposed under section 36, 37 or 38, the
Commission shall serve on that person a notice in writing of the
refusal.
