from any record or other document relating to the business
to which such certificate of registration applies.
(2) For the purpose of enabling an authorized person to
exercise his powers under subsection (1)(b), he may require the
registered person or any other person whom he reasonably believes is
in possession of or has under his control any record or other
document mentioned in that subsection to produce it to him.
(3)
For the purpose of an inspection under subsection (1)(b), the
registered person or other person mentioned in subsection (2) shall
afford an authorized person access to such records or other documents
as may be required for the inspection, and shall produce to the
authorized person such records or other documents as he may require.
(4) Nothing in this section shall be construed as requiring an
institution authorized to carry on banking business or the business
of taking deposits under the Banking Ordinance (Cap. 155) to produce
any record or other document relating to the affairs of a customer to
an authorized person unless the Commission is satisfied that such
production is necessary for the purposes of this section and certifies
in writing that that is the case; and where the Commission so
certifies in respect of any such institution, such institution shall
comply with any requirement under subsection (2) or (3) that applies
in its case.
(5) Any person who, without reasonable excuse, contravenes
subsection (3) commits an offence.
