(2) In considering whether an applicant for registration
referred to in subsection (1) is a fit and proper person to be so
registered the Commission shall, in addition to any other matter that
the Commission may think relevant, have regard to the matters set
in subsection (3) in respect of -
(a) the applicant if he is an individual;
(b)
where the applicant is a company, each of its directors and
officers; or
(c)
where the applicant is a partnership, each of the partners.
(3) The matters referred to in subsection (2) are in the case of
an applicant and any other person to whom that subsection applies
(a) his financial integrity and reliability;
(b)
his educational or other qualifications or experience
having regard to the nature of the functions which, if the
application is allowed, he will perform;
(c)
his ability to perform such functions efficiently, honestly
and fairly; and
(a) his reputation and character.
(4) For the purposes of this section, the Commission may have
regard to any information in its possession whether furnished by the
applicant or not.
