PROPOSED MULTI-LATERAL TREATY ON PROTECTION OF SEMICONDUCTOR TOPOGRAPHIES

Thank you for your letter of 23 December replying to mine of 14 December.

As promised in my earlier letter, I enclose copies of our own notes on the meetings held in Geneva last November.

I look forward to hearing from the FCO and in this respect there is one essentially peripheral, but potentially significant, point of which they should be aware. This was a request by Holland, made in co-ordination, that the EC should press for the Treaty to deal explicitly with colonies. Fortunately, we (aided by the Council Secretariat) were able to make it clear to Holland that this would not be a good idea without ever mentioning the word So "Gibraltar". Holland therefore did not pursue the matter. far as the other EC delegations were concerned, many clearly did not have a clue what was going on and this may have been true of the Spanish delegation who did not bat an eye or say a word throughout.

In this connection, it is my understanding that colonies (or dependencies) are not dealt with explicitly in Treaties but are dealt with when the responsible State becomes party to a Treaty. In any event, we will need to be prepared to deal with the problem and I should be grateful for FCO advice on this matter also.
