PROPOSED MULTILATERAL TREATY ON PROTECTION OF SEMICONDUCTOR TOPOGRAPHIES : COMMUNITY CO-ORDINATION
I have today received a paper (copy enclosed) for the Community co-ordination meeting to be held in Brussels on 22/23 February and I should be grateful for advice on the competence question, at the latest by noon on the 21 February please.
As you will see the paper has to some extent been overtaken by the draft Treaty issued by WIPO and circulated with my letter of 13 February. However, knowing the time taken to obtain authorisation within the Commission for Community papers, I should be very surprised if we get anything more up to date before the meeting on the 22nd.
The paper covers a number of technical questions on the protection to be given to semiconductor topographies under the Treaty which I shall be happy to field on the basis of our new Act, The Copyright, Designs and Patents Act 1988, eg non- voluntary licensing. However it also deals with the vexed question of competence. On a quick glance, which is all I have so far been able to give it, the paper takes a line which seems to me to be a reasonable extrapolation. However, I should be grateful for expert advice from FCO, Cabinet Office, and DTI legal advisers. To this end I have taken the liberty of copying this letter to Mark Blythe in Treasury Sols, as well as recipients of my letter of 13 February.
