The legal security legitimately claimed by other States which may become

party to the future treaty resides in the fact that the EEC must become a

party alongside its Member States. This is the means of providing the

In addition, this combined participation strengthens the guarantees that

the agreement will be implemented and increases the number of parties to

whom a third party can address itself. It therefore does not only

accomodate the legal constraints which exist within the EEC but it

provides at the sames time an advantage to those parties who wish to

establish relations in this field with the economies which together

constitute the European Communites.

In accordance with Article 228 paragraph 2 of the Treaty of Rome, an

agreement between the Community and one or more States is binding on the

Institutions of the Community and on the Member States. Therefore, if

there is any obligation which needs to be implemented by the Member

States in respect of an agreement concluded by the Community Member

States will be bound as a direct result of the Treaty of Rome. Under

this Treaty, the Commission and the European Court of Justice have the

ability to ensure that Member States do indeed honour the obligations

thereby falling on them.
