Subparagraph (1) (a) (b) and (c) are acceptable.
Common position
Subparagraph (1) (d) allows the Assembly to ask WIPO to grant
financial assistance to facilitate the participation of delegations
from developing countries. As it is not proposed that Contracting
Parties should pay contributions to the International Bureau of WIPO,
such assistance would have to be financed out of the General Budget to
which only the Member States contribute.
Furthermore a provision of this kind could constitute a precedent for
other Unions and as such entail further obligations and
Institutionalise the compromise accepted so far only exceptionally. On
the other hand in the particular case of the present Treaty and with
the rather weak wording that the Assembly "may ask" WIPO, the real
Impact seems rather small. In any case it is not worth having a major
debate on such a provision ; If necessary, it should be accepted,
perhaps subject to the availability of funds in the general budget of
WIPO.
