The power of commutation rests in the Governor's hands alone and since 1975 all death sentences have been commuted by him. Nevertheless, in each case the advice of ExCo is sought although, by convention,

by convention, ExCo advises not on the question of whether or not a death sentence should be commuted but only on the appropriate alternative sentence to be imposed were the Governor to commute. By custom, and to mark the seriousness of the decision involved, consideration of such cases always comes before consideration of the main ExCo agenda.
