4. Both sides agreed that the repatriates will be treated
humanely before and after their return to Vietnam. The
repatriates will not be punished for leaving Vietnam
clandestinely.
However, those who committed criminal acts
before their departure from Vietnam, will be liable to
punishment according to Vietnamese law. In such cases, the
Vietnamese side will inform the British side in advance.
When necessary, the Vietnamese side will be prepared to arrange
contacts between representatives of the British Government or
the UNHCR and the repatriates in order to make available
information on their situation.

5. The British side will recommend that the UK and the Hong
Kong Governments should be responsible for arranging the
financing of repatriation and re-integration.
will sign an agreement on these aspects before the first
repatriation takes place. If appropriate, the two sides will
ask the UNHCR to participate in this process.
The Vietnamese side reiterated the need for development aid
to the areas in Vietnam where many clandestine departures take
place. The British side took note of this point and will
report back to the British Government for consideration.
