(3) The requirement for unanimity should only be relaxed

to the extent of allowing resolutions to be passed

or advice to be formulated with no more than one

dissenting vote,

A quorum should consist of no less than 5 members if

the total membership of the JSC is to be 7 and no

less than 7 if the total membership of the JSC is to

be 9.

Judicial appointment should be made by the Governor

in accordance with the advice of the Judicial Sex-

vice Commission.

B.

Comments on the Bill

(1)

The bill proposes an increase in the appointed mem-

bers to "not more" than 6 of whom 2 shall be Judges.

1 shall be a barrister and 1 shall be a solicitor,

and 2 shall be persons who are not in the opinion of

the Governor connected in any way with the practice

of law in Hong Kong. Thus, while part of the pro-

posed amendment provides for no more than 6

appointed members (thus contemplating the possibi-

lity of less than 6), the remaining part of the

amendment makes it mandatory for the Governor to

appoint the full 6.

(a) The amendments also increase the quorum from

the Chairman and 2 other members to the Chair-
