The Bar Association and the Daw Society, having
considered the present constitution, functions powers and
procedures of the Judicial Service Commission and the proposed
changes contained in the Judicial Service Commission
(Amendment) Bill believe that the following changes should be
made in the interests
interests of ensuring the independence of the
Judiciary:
(1)
The Attorney General and the Chairman of the Public
Service Commission should no longer serve as members
of the Judicial Service Commission.
(a)
The Attorney-General
(i)
The Chief Secretary, in introducing the
Bill into the Legislative Council stated
that in the Government's view, it was
entirely appropriate that both the AG
and the Chairman of the PSC should be
members, the AG because of his role as
the Governor's adviser on legal matters
and the Chairman of the PSC because of
his independent status and his expertise
in appointment matters.
