Legal Arrangements between the UK and Hong Kong: the UK Perspective. Dated 6 August 1987. This has not been copied to Hong Kong, although they are aware in general terms that it is an area on which we have begun to focus.

Also enclosed (at E) in the file are two passages drafted by Mr Fifoot in relation to a recent letter from Lord Winchilsea about

the status of prisoners after 1997. They touch on the need to ensure, between now and 1997, that we have adequate safeguards in place with the PRC to cover the position of anyone who has been or will be returned to Hong Kong from the UK.

3. At the time of writing there is no action required from us (ie the FCO) on any of these. In the case of (D) it is unlikely that we will need to think of action until somewhere near the mid-1990s. Mr Fifoot's suggestion, however, I have collected all four papers together (plus the additional paragraphs on arrangements with the PRC) so that they may annually be brought up for review. It will be important for the Department (and their Legal Adviser) to keep all the substantive issues and the state of action in relation to each

of them in view.
