may be frustrated if the CE refuses to consent by virtue of Art. 73 to the re-introduction into the re-elected LegCo any bill he has twice refused to sign, which has led to the dissolution of the former LegCo under Art. 50.

Art. 78(4) may rule out the possibility of LegCo

members taking up

government appointments,

including those to advisory

(e.g. TAC) or statutory

(e.g. HA) bodies; and

prevent the possible

evolution of a

quasi-ministerial system

with LegCo members assuming chairmanship of major

advisory bodies. It should preferably be deleted.

(9) Art. 78(4) should be deleted.
