If the Legislative

Council refuses to pass the

budget bill presented by the government, the Chief Executive may apply for temporary appropriations from the Legislative Council. If appropriation of public funds

cannot be approved because the Legislative Council is

already dissolved, the Chief Executive may approve temporary short-term appropriations according to the level of the previous fiscal year's expenditure prior to the election of the new Legislative Council.

Article 52

The Chief Executive shall have to resign under any

of the following circumstances :

When he/she loses the ability to discharge the functions of his/her office due to serious illness

or other reasons;

When, after the Legislative Council is dissolved

because he/she twice refuses to sign the bill it

passes, the new Legislative Council has ag ain

passed the original bill in dispute with a

two-thirds majority and he/she still refuses to

sign it; and

When, after the Legislative Council

Council is dissolved

because it

it refuses to approve the budget or any

other important bill, the new Legislative Council

still refuses to pass the original bill in dispute.

Article 53

If the Chief Executive of the Hong Kong SAR is not

able to discharge his/her duties for a brief period, such duties shall temporarily be assumed by Administrative

Secretary, Financial Secretary, Secretary of Justice in the

above order of precedence.
