A BILL

To

Amend the Criminal Procedure Ordinance.

Enacted by the Governor of Hong Kong, with the advice and consent

of the Legislative Council thereof.

1. This Ordinance may be cited as the Criminal Procedure (Amend- Short title. ment) Ordinance 1988.

Section 65B(3)(c) of the principal Ordinance is amended by Amendment of deleting the comma after “thereof” and substituting the following—-

"and, unless otherwise agreed by or on behalf of the prosecutor and defendant (or, if more than one, all the defendants), the translation shall be".

Explanatory Memorandum

The purpose of this Bill is to amend the Criminal Procedure

Ordinance.

2. Section 65B of the principal Ordinance allows the admission into evidence in any criminal proceedings, other than committal proceedings, of written statements. Subsection (3)(c) requires any statement in a language other than English to be accompanied by an English translation certified by a court translator. By clause 2 of the Bill, section 65B(3)(c) is amended to dispense with the need for the certification of translations if all the parties

agree.
