according to the law of the contracting party which gives the
judgment, the litigant who loses the lawsuit has not been
legally summoned by the court;
the litigant has been deprived of the possibility of defence,
or has been deprived of an appropriate agent when he suffers
incapacity;
the court within the territories of the contracting party
which is going to accept or execute the judgment has already
given judgment with legal effect in a case concerning the same
litigants on the same object of procedure, or the case is in
progress, or it has already accepted the judgment with legal effect in the
case given by the court of a third country;
accepting or executing the judgment will jeopardise the basic
legal principles or public order of the contracting party
which is going to accept or execute the judgment.
Article 21
Acceptance and Execution of the Ruling of the Court of
Arbitrators
The contracting parties should mutually accept and execute the
arbitrators' ruling given in the territories of the other party according
to the Convention on the Acceptance and Execution of Foreign Arbitral
Awards signed in New York on June 10, 1958.
