Judicial Assistance - Hong Kong and Guangdong: In the last issue we reported... the conclusion of a judicial assistance agreement between the Hong Kong Supreme Court and the Guangdong High People's Court. Details of the agreement were not · available at the time of publishing that issue!: and accordingly we have attempted to pursue. the matter. Howevers attempts to obtain a cory of this agreement have been thwarted.! Most recently, we were told by a privatel source that thereyisin fact.no formall agreeinent but merely an exchange of letters between the Registrar of the Supreme Court and the President of the Guangdong People's High Court. According to our source, the agreement relates only to the mutual service? of documents. In this regard, the Supremet Court has informed us that:

If such service is required, it will be necessary for application to be made for leave to serve out of the jurisdiction and, when that leave has been given, for the documents to be served to be passed to the Chief Judicial Clerk, Supreme Court Registry, who wil! arrange through the Registrar of the Supreme Court for service by the Guangdong Court. In due course, after service, formal Certificate of Service will be provided.

Documents for service in Hong Kong will be forwarded to the Registrar, Supreme Court by the Highe. Peoples Court of Guangdong and will be served by the Supreme Court by post or personally by the bailiff if such request is made."
