I am a member of Special Duties Unit in the Attorney-General's Chambers and of the British (Hong Kong) team that negotiated with the Chinese.

I understand that the Criminal Justice Act (extradition provisions) are now effective and that the U.K. will be in a position to ratify the European Convention on Extradition.

I would be very grateful if you could let us know what the legislation provides (especially as regards dependent territories) and how you see Hong Kong maintaining its "separate" system, both so as to be in position to start down the road proposed at J.L.G. and not to be encumbered with any new "European" obligations.
Personally I can see no advantage in having the Council of Europe Convention applied to Hong Kong; indeed there is positive disadvantage because of our desire to retain the prima facie rule (a matter on which we would need to reserve) and in the necessity to consult the Chinese.
