THE PROBLEM
On 15 March 1988, after considering memorandum
XCC (88)21A (Annex A), Council advised and the Governor ordered, inter alia, that the Broadcasting Authority should be invited to consider

what period of notice would be appropriate in place of 18 months when a licence is revoked pursuant to Sections 14(1) and (2) of the Television Ordinance;
the case for introducing a power
power to suspend a licence and the appropriate period of suspension; and
as an alternative to the royalties proposal, the feasibility of imposing а levy on television advertising revenue.

In addition, the Broadcasting Authority has expressed concern about the standard of television programmes of Television Limited (ATV) and its poor audience
audience rating. Authority suggests that before ATV's licence is renewed, the licensee should undertake to make sufficient capital investments to improve its service.
RECOMMENDATIONS AND ADVICE SOUGHT
