in subsection (1) shall be the amount which

in the circumstances of a particular case

would reasonably be expected to be agreed to

between the parties concerned were they

negotiating in the open market and at arm's

length.

(3) The licences or other permissions

referred to in subsection (1) are licences

or other permissions given by a licensee to

another person enabling that person, or any

other person who is specified in the licence

or permission or who is of a class or

description so specified, to broadcast,

rebroadcast, relay or otherwise transmit any

broadcasting material or to hire or

otherwise to supply to a third person any

such material for broadcasting,

rebroadcasting, relaying or otherwise

transmitting, or for any other purpose.

(4) A licensee shall make a payment to

the Director of Accounting Services of the

amount (if any) due on account of the royalty

payable by him under this section in respect

of a quarter beginning on the 1st day of

January, the 1st day of April, the 1st day of

July or the 1st day of October in any year.
