(b) the employee would have been entitled to a long service payment had he earned wages not exceeding $11,500 per month at the time of such dismissal,
he shall be entitled to a long service payment in respect of the whole of the period of employment during which his wages did not exceed $11,500 per month.”.

Section 31Y(2) is amended by adding "reference therein to a" before "provident fund".
10. The following is added after section 31Y-
"Gratuities or
31YA. (1) Subject to subsection (2), where an
provident fund employee dies and—
payment on death of
employee
(a) by virtue of this Part, a person is entitled to a long
service payment; and
(b) by virtue of—
(i) the terms of the employee's contract of em- ployment, a gratuity based upon length of service;
or
(ii) a provident fund scheme or arrangement, any payment thereunder,
is payable upon termination of employment,
the total sum of the amounts of all the gratuities or provident fund payments, as the case may be, in relation to the years of service in respect of which that long service payment is payable may be reduced by the total amount of the long service payment.
(2) For the purposes of subsection (1), any reference therein to a provident fund payment shall not include that part, if any, of the payment which represents a return of an employee's own contributions, including any sum payable in respect of interest thereon.".
11. Section 31ZC is repealed and the following substituted—
"Death of employer
Sixth Schedule
31ZC. The Sixth Schedule shall have effect in relation to the death of an employer.".
12. Section 31ZD(1) is amended by repealing "the employee" and substituting "the person entitled to the payment".
13. Section 31ZE is amended by repealing "the employee" wherever it occurs and substituting "the person entitled to the payment".
