(b) matter referred to in section 32(1) of the Film Censorship Ordinance 1988 which is approved for publication or exhibition under regulation 8 of the revoked regulations within the meaning of section 32(3) of that Ordinance; or

(c) material within the meaning of section 2 of the Television Ordinance permitted to be broadcast under that Ordinance.'

(b) in section 10(1), by deleting paragraph (a) and substituting the

following-

“(a) standards of morality, decency and propriety that are generally accepted by reasonable members of the community, and in relation thereto may, in the case of an article, have regard to any decision of a censor under section 10 of the Film Censorship Ordinance 1988 in respect of a film within the meaning of section 2(1) of that Ordinance;"; and

(c) in section 21(2)(c)(ii), by deleting "to the panel of censors under

section 32 of" and substituting the following-

"under that Ordinance for broadcast under".

Explanatory Memorandum

The object of this Bill is to-

(a) repeal and replace the provisions relating to the censorship of films presently contained in the Places of Public Entertainment Ordinance (Cap. 172) and in the Film Censorship Regulations 1987 (L.N. 154/87) made under that Ordinance; and

(b) introduce a new system of film classification.

Part I comprises clauses 1 and 2. Clause 1 provides that the Bill shall come into operation on a date to be fixed. Clause 2(1) sets out definitions of terms used in the Bill, including definitions of "exhibition" and "film". Clause 2(2) is an interpretative provision which specifies, in relation to the exhibition of a film, the person who shall be taken to exhibit the film for the purposes of the Bill.

3. Part II comprises clauses 3 to 6. Clause 3 establishes the Film Censorship Authority. Clause 4 establishes the panel of censors. Clause 5 provides that the Authority may appoint from the panel of censors such censors as may be necessary for the purposes of the Bill. Clause 6 establishes the panel of advisers.
