An Ordinance to amend the Public Health and Municipal Services

Ordinance.

[1 October 1988]

Enacted by the Governor of Hong Kong, with the advice and consent

of the Legislative Council thereof.

1. This Ordinance may be cited as the Public Health and Municipal Short title and Services (Amendment) (No. 2) Ordinance 1988 and shall come into commencement operation on 1 October 1988.

2. Section 56 of the Public Health and Municipal Services Ordinance Regulations as is amended by adding after subsection (6) —

to food and drugs hygiene

"(7) In this section, "premises" includes a stall or vessel and in (Cap. 132) relation to a vessel, “occupier" means the master.".

3. (1) Section 128(1) is amended-

(a) by repealing "Save as otherwise expressly provided, where, under

the provisions of" and substituting "Where, under";

(b) by repealing "make an order closing such premises or vessel, either wholly or in part, or prohibiting the use thereof for all or any purposes" and substituting

subject to subsection (5), make an order in Form F in the Seventh Schedule (in this section referred to as a "Prohibition. Order") prohibiting the use of such premises or vessel, or any specified part thereof (in this section referred to as the "specified part"), for all purposes, or for any purpose specified in the order, with effect from the 8th day after copies of the order have been served under subsection (6)”.
