CONVEYANCING AND PROPERTY (AMENDMENT) ORDINANCE 1988

The objects of this Ordinance are to improve and refine the Conveyancing and Property Ordinance in the light of experience gained since its enactment in 1984.

The Ordinance contains numerous amendments of
a technical nature, most of which are of minor importance. The more important amendments are as follows
(a) the period for which a vendor must prove title
is reduced from 25 years to 15 years (clause 5(a)(i));

a vendor is required to produce a power of attorney under which a document produced was executed only if that document was executed less than 15 years before the contract of sale (clause 5(a)(ii));
the law relating to the enforcement of covenants, which is particularly important in relation to multi-storey buildings, is clarified (clause 12).
Before the Governor assented to the Bill in the name and on behalf of Her Majesty, the Attorney General advised that he could properly do so.
