NURSES REGISTRATION (AMENDMENT) BILL 1987

5. Section 12(1) of the principal Ordinance is amended by deleting Amendment of "headquarters of the Medical and Health Department" and substituting the section 12. following-

"offices of the Board".

6. (1) The Nurses (Registration and Disciplinary Procedure) Regula- Consequential tions are amended in regulations 15(1)(b)(iv), (4), (6)(d) and (8) and 31(a) by amendments. deleting "Director" wherever it occurs and substituting the following

"chairman".

(2) The Enrolled Nurses (Enrolment and Disciplinary Procedure) Regulations are amended in regulations 15(1)(b)(iv), (4), (6)(d) and (8) and 31(a) by deleting "Director" wherever it occurs and substituting the following

"chairman".

Explanatory Memorandum

The main purpose of this Bill is to substitute the Director of Medical and Health Services by the Nursing Director of the Medical and Health Department as an ex officio member of the Nursing Board of Hong Kong, and to provide for the election of the chairman by members of the Board.

2. Clause 2(a) includes in the definition of "chairman" a member elected to act as chairman in the latter's temporary absence. Clause 2(b) substitutes the Nursing Director of the Medical and Health Department for the Director of Medical and Health Services in the definition of “"Director". (This makes the Nursing Director an ex officio member of the Board in place of the Director of Medical and Health Services.) Clause 2(c) deletes the already obsolete post of Principal Nursing Officer.

3. Clause 3(a) substitutes one Government registered nurse nominated by the Director of Medical and Health Services for the Principal Nursing Officer as a member of the Board, the post of Principal Nursing Officer having been abolished, and also provides for the appointment by the Governor of one additional member to be nominated by The Chinese University of Hong Kong and one lay member. By clause 3(b) provisions are made for the election of the chairman by the members of the Board and for the term of office, absence and resignation of the chairman. Clause 3(c) abolishes the post of social studies adviser nominated by The Chinese University of Hong Kong as there is now already in the Board a member nominated by The Chinese University of Hong Kong.

4. Clauses 4 and 5 substitute the offices of the Nursing Board for the headquarters of the Medical and Health Department as the place where the register of nurses and the roll of enrolled nurses are kept.

5. Clause 6 sets out the consequential amendments to the Nurses (Registration and Disciplinary Procedure) Regulations and the Enrolled Nurses (Enrolment and Disciplinary Procedure) Regulations. The powers and functions of the Director of Medical and Health Services under those regulations are transferred to the chairman of the Board.

6. This Bill has no Public Service staffing or financial implications.
