Explanatory Memorandum
The main purpose of this Bill is to substitute the Director of Medical and Health Services by the Nursing Director of the Medical and Health Department as an ex officio member of the Midwives Board of Hong Kong, and to provide for the election of the chairman by members of the Board,
2. Clause 2(a) includes in the definition of "chairman" a member elected to act as chairman in the latter's temporary absence. Clause 2(b) substitutes the Nursing Director of the Medical and Health Department for the Director of Medical and Health Services in the definition of "Director" so as to make the Nursing Director an ex officio member of the Board.
3. Clause 3(a) substitutes a registered midwife in the public service for the Principal Nursing Officer as a member, the post of Principal Nursing Officer having been abolished. It also adds to the list of members one medical practitioner nominated by The Chinese University of Hong Kong and one lay member, both appointed by the Governor. By clause 3(b), provisions are made for the election of the chairman by the members and the term of office, absence and resignation of the chairman.
4. Clause 4 sets out the consequential amendments to the Midwives (Registration and Disciplinary Procedure) Regulations in a Schedule to the Bill. The powers and functions of the Director of Medical and Health Services under those regulations are to be transferred to the chairman of the Board.

The Bill has no Public Service staffing or financial implications.
