MOST BOAT PEOPLE ARRIVING IN HONG KONG ARE NOT CONSIDERED POLITICAL

REFUGEES. CAN INTERNATIONAL COMMUNITY BE EXPECTED TO RESETTLE THE

RECENT INFLUX?

Recent influx before introduction of new policy have been accepted in Hong Kong as refugees in accordance with the arrangements agreed in Geneva in 1979. Under these arrangements all such refugees have access to resettlement. We will be pressing the international community to continue playing its part in discharging

its responsibilities under understanding reached in Geneva in 1979.

REACTION OF OTHERS TO NEW POLICY

We have explained the new policy to the major resettlement

countries and UNHCR. All understand the reasons for the new

policy.

UNHCR'S REACTION TO THE NEW POLICY

HMG have been in close touch with UNHCR in Hong Kong and in

Geneva on the situation in Hong Kong and the need to take early

measures. UNHCR have indicated that they will work together with

the HKG and HMG on the setting up of new arrangements with the

objective of ensuring that the needs of genuine refugees are met. HMG appreciates this help from UNHCR.

IS NEW POLICY CONSISTENT WITH INTERNATIONAL COVENANTS ON POLITICAL

AND HUMAN RIGHTS?

We are satisfied that the changes introduced by the new policy

are not inconsistent with our obligations under the covenants.

REPATRIATION IS MORALLY UNACCEPTABLE?

Repatriation would be on the basis of suitable guarantees about

no ill treatment. Must be morally preferable to indefinite

detention in closed camps in Hong Kong, which is in effect the

present position of most boat people.
